These Terms of Service ("Terms") govern your use of fulcrumgo.com (the "Site"), operated by Elite Branding LLC, d/b/a Fulcrum AI ("Fulcrum AI," "we," "us"), a New York limited liability company. By using the Site or downloading the free guide, you agree to these Terms.

1. The Site and the Free Guide

The Site describes Fulcrum AI's AI automation consulting services and offers a free operating-map guide in exchange for your email address. The guide is provided for your personal or internal business use. You may not resell, redistribute, or republish it without our written permission.

2. No Client Relationship From Browsing

Using the Site, downloading the guide, or booking an introductory call does not create a consulting, agency, or client relationship between you and Fulcrum AI. Paid engagements are governed exclusively by a separate signed agreement (statement of work, sprint agreement, or retainer contract), which controls over these Terms for any conflict regarding that engagement.

3. Intellectual Property

All content on the Site — including the guide, copy, graphics, and branding — is owned by Fulcrum AI or its licensors and is protected by copyright and trademark law. Nothing in these Terms transfers ownership of that content to you.

4. Disclaimer of Warranties

The Site and the free guide are provided "as is" and "as available," without warranties of any kind, express or implied, including fitness for a particular purpose or non-infringement. We do not guarantee the guide's accuracy or that it applies to your specific business or legal situation.

5. Limitation of Liability

To the maximum extent permitted by law, in no event shall Fulcrum AI or Elite Branding LLC be liable for any indirect, incidental, special, consequential, or punitive damages, or for any damages exceeding the amount paid by you to Fulcrum AI in the twelve (12) months preceding the claim. If you have paid us nothing, our total liability is limited to one hundred dollars ($100).

6. Indemnification

You agree to indemnify and hold harmless Fulcrum AI, Elite Branding LLC, and their owners and contractors from any claims, damages, liabilities, and expenses (including reasonable legal fees) arising from your use of the Site, your violation of these Terms, or your violation of any law or third-party right.

7. Governing Law and Venue

These Terms are governed by the laws of the State of New York, without regard to its conflict-of-law principles. Any dispute arising from these Terms or your use of the Site shall be brought exclusively in the state or federal courts located in New York, and you consent to personal jurisdiction there.

8. Changes to These Terms

We may update these Terms from time to time. Continued use of the Site after a change constitutes acceptance of the revised Terms. The "Last updated" date above reflects the most recent revision.
